ECT Statutory Induction Privacy Statement

Derbyshire County Council is committed to protecting your personal data and ensuring it is processed fairly and lawfully. Information you provide to Derbyshire County Council will be processed in accordance with the General Data Protection Regulation, the Data Protection Act 2018 and any subsequent legislation.

Derbyshire County Council is the Data Controller for the purposes of processing your information under the data protection legislation.

The information you provide allows us to support you through your Early Career Teacher (ECT) statutory induction.

Purpose of processing The data collected will include personal identifiers such as your name, date of birth, contact details, and characteristics such as qualifications, work-related performance and absence information. We will use this information for the purposes of managing the ECT statutory induction process to:

• enable us to correctly identify you and ensure you are registered as a qualified teacher; • provide appropriate support to complete your induction against the Teachers’ Standards; • provide ECT services such as training courses, information updates and conferences.

Lawful basis for processing In order for us to support you through your induction, it is necessary for us to use your personal information to help assess your needs and identify the most appropriate services available. To do so we will use the following legal basis for processing your information:

• Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller

The relevant legislation that we are carrying out our public task under is:

• S.135A, s.135B and s.141C(1)(b) of the Education Act 2002 (as amended by the Education Act 2011); and • the Education (Induction Arrangements for School Teachers) (England) Regulations 2012 • Induction for early career teachers (England): Statutory guidance for appropriate bodies, headteachers, school staff and governing bodies

Who will receive this information? We will not share information about you with third parties unless the law allows us to. We may share your information with Derbyshire schools, and are required, by law, to pass on some of this personal data, for example:

• other Appropriate Bodies, for instance, when an ECT transfers to another school out of County; • the Department for Education (DfE), for instance, statistical data such as subject or phase; • Teaching Regulation Agency (TRA) to enable you to receive accreditation.

How long will Derbyshire County Council hold this information for? Your personal information will be retained for seven years from the date that you complete your induction or leave the Appropriate Body, in line with the statutory guidelines. The information provided will be kept in accordance with the Council’s Records Retention Schedules. How will the information be kept secure? Derbyshire County Council is committed to protecting personal data and has policies and procedures in place to ensure that it is safeguarded.
